Terms for Tutoring

Tutoring Contract and Conditions

By Purchases Services, You Agree to the Following:

FEES 

Payment is due prior to the start of any sessions

$65 for 60-minute sessions held online.

New clients must fill out the following form at least 6 hours to the start of the session to avoid the session being canceled. https://learningleaf.teachworks.com/form/consultation-form

You may book as many sessions as you would like. Any funds remaining in your account can be applied to future tutoring sessions. NO REFUNDS will be provided. 

We will be using learningcube.com for online sessions. Your session may be recorded only you and your tutor will have access to it.

CANCELLATION OF SESSIONS FOR ONLINE SESSIONS

Learning Leaf requires the client to cancel a session 5 hours before the start of the session. If a 5-hour notice is not given, the client will be charged the full amount of scheduled sessions.

  • The session fee will be assessed for the scheduled time of the session. If a 30-minute session was missed, the client will be charged for a 30-minute session, if an hour session was missed the client will be charged for an hour session and so on.  A missed session is when a student does not show up for the session at the scheduled start time or does not notify the tutor at least 5 hours prior to the session start time. 
  • Failure to pay for a missed session will result in termination of services.

To avoid a charge for the session the following procedure must be met. 

  • Text or email the tutor directly to inform them of the cancellation. This must be timestamped for at least 5 hours prior to the beginning of the scheduled session.
  • If you do not receive confirmation of the text or email within 4 hours of the session beginning please email info@mylearningleaf.com.

LATE ARRIVAL and EARLY DISMISSAL

  • No adjustment shall be made for time lost because of late arrival by the Student or because of early dismissal as required by the Student either in-person or online; the client will be charged the full amount of the scheduled session.
  • If the tutor arrives late or needs to leave early, the current session will be extended if possible, or time will be added to the following session, by the amount of time that was lost. If this is not possible then the client will be refunded at the rate/minute of time that was lost.

Fees may be adjusted from time to time and shall become effective after having given the Student (14) fourteen-day written notice.

INVOICES AND PAYMENT OF MISSED SESSIONS

Invoices will be sent via email, monthly and in advance for the upcoming month’s sessions. Payment is due prior to the start of any sessions

  • Any unused funds will be applied to the next month’s invoice. 
  • If additional sessions are added during the month, they will be billed separately and will be due within 14 days of receipt
  • At the termination of service, any unused fund may be requested by the client with a written notice within 30 days of the cancellation notice. 
  • It is ultimately up to the client to send a written statement (email is acceptable) requesting funds. 

Failure to pay for sessions on time may result in a delay or termination of services.

Payment Details for late fees.

  • A $10 late fee will be applied for all balances under $100 after 30 days
  • A $15 late fee will be applied for all balances $100 and over after 30 days
  • A $25 late fee will be applied to any balance after 31 days
  • A $25 fee will be applied for all returned checks

COLLECTIONS/PENDING COLLECTIONS

  • All balances sent to collections will be charged a $55 collection fee

Accepted methods of payment:

Check – written out to Learning Leaf (each invoice gives instructions for how to use online bill pay through your bank)

Credit cards – Master, Visa, Discover, American Express

CANCELLATIONS BY STUDENT FOR IN-PERSON SESSIONS                          (We are currently only meeting with students online).

Learning Leaf requires the client to cancel a session 24 hours before the start of the session. If a 24-hour notice is not given, the client will be charged the full amount of scheduled sessions. To avoid a charge for the session the following procedure must be met

  • The session fee will be assessed for the scheduled time of the session. If a 30-minute session was missed, the client will be charged for a 30-minute session, if an hour session was missed the client will be charged for an hour session and so on.  A missed session is when a student does not show up for the session at the scheduled start time or does not notify the tutor at least 24 hours prior to the session start time.
  • Failure to pay for a missed session will result in termination of services.

SICK POLICY

For in-person sessions ONLY.

  • If a student is sick and does not attend school on the day of the session, the tutor must be notified via email, phone call or text by 9:00 am the day of the session
  • If the student attends school but goes homesick, the tutor must be notified within an hour of the student leaving school, by a phone call or text and this must be at least 2 hours prior to the scheduled session
  • Under no circumstance will a cancellation fee be waived if the tutor is called within 2 hours of the scheduled session. 
  • Failure to comply with this policy can result in termination of services.

SNOW EMERGENCY POLICY

For in-person ONLY.

  • If there is a Level 2 snow emergency an in-person session will be canceled with no charge. 
  • If the school district in which the student attends cancels school an in-person session will be canceled with no charge.  
  • If students are on a 2-hour delay the session will still be scheduled and the normal cancellation policy will apply.  
  • If students are sent home early from school, in-person sessions will be canceled with no charge.

TECHNICAL DIFFICULTIES

For online sessions ONLY. 

  • If the student is unable to attend an online session due to technical difficulties an attempt to conduct the session over the phone must be made. 
  • If there is a power outage or internet failure, the client must notify the tutor immediately and the session can be rescheduled with the tutor and no charge will occur.
  • If the tutor is unable to attend an online session due to technical difficulties the client will not be charged.

TUTOR CANCELLATIONS

If a tutor cancels a session for any reason the client will not be charged for the session.

Please note: These policies are set forth by Learning Leaf and are strictly enforced to protect our tutors. Asking a tutor to not report, or falsely report an absence will result in a termination of the contract.

NO WARRANTIES

Learning Leaf makes no promises or warranties with regards to a Student’s performance as a result of any tutoring provided. 

TERMINATION

This tutoring contract may be terminated by either party at any time.  If a session is scheduled termination must be given 24 hours prior to the next scheduled session.

  • Any fees incurred up to the time of cancellation shall be due, any balance on the account will be returned when written notice is given up to 30 days after the cancellation. 
  • At the termination of service, any unused fund may be requested with a written notice within 30 days of the cancellation notice. 
  • It is ultimately up to the client to send a written statement (email is acceptable) requesting funds. 

WHOLE AGREEMENT

This agreement constitutes the entire understanding between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Any alteration to this agreement must be in writing and signed by both parties.  The contract takes effect immediately. If services do not begin within 6 months of activating this contract, a new contract may need to be drawn.

MINORS

Where the Student is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the Student and shall accept and agree to all the terms and conditions contained herein on behalf of the Student.
